Davao Tourist Passport — privacy notice

This notice covers personal data handled specifically in connection with the Davao Tourist Passport programme. It supplements, and does not replace, Horai's Privacy Policy, which covers the Horai App and Horai Web generally. The Philippines-specific commitments below (data controller, data protection officer, and NPC registration status) apply to this programme; they do not change how Horai's general Privacy Policy applies to the rest of the service.

Who is responsible for your data

Davao Tourist App powered by Horai is operated by scheme verge, Inc. (401 Todaimae HiRAKU GATE, 2-3-10 Mukogaoka, Bunkyo-ku, Tokyo, Japan), which is the Personal Information Controller (PIC) under the Philippines Data Privacy Act of 2012 (RA 10173) for personal data processed through this site and through the Horai App in connection with this programme. DATA and the City Tourism Operations Office (DCTOO) are separate organisations; any information you give directly to them or to a participating establishment is not covered by this notice.

What we collect from this site

This site has no account registration and no forms — you are not asked to type in any personal information. If you consent to analytics cookies (see below), we and our analytics providers may automatically receive technical data such as your device or browser type, the pages you view, and an approximate location derived from your IP address.

This site may use optional analytics and advertising cookies. Nothing is set until you choose to accept them in the banner shown on your first visit, and no request is made to Google or Meta before that point.

You can withdraw analytics consent at any time. This stops the Google Analytics tag from loading until you decide again.

You can withdraw advertising consent at any time. This stops the Meta Pixel from loading until you decide again.

What the Horai App collects for this programme

If you use Davao Tourist App powered by Horai through the Horai App, the app may collect the following, either automatically or from what you enter. This is collected by the app itself, not by this website:

Not all of these are collected in every case; what is collected depends on the features you use.

Withdrawing consent for the Horai App

You can stop the app from accessing your location at any time by turning off the location permission for the app in your device settings (on iOS, Settings → Privacy & Security → Location Services; on Android, Settings → Apps → Permissions). An in-app control for this is planned for a future update.

Why, and on what basis

On this website, we rely on your consent. You can choose analytics and advertising separately, and withdraw either of them at any time using the controls above.

In the Horai App, we rely on two different bases. Information we need in order to provide a feature you have asked for — for example, your location when you use the map or route guidance — is processed in order to perform our agreement with you under the Horai Service Terms. Information used to understand and improve the app is processed on the basis of your consent.

Who we share it with

If you consent to analytics, technical data is processed by Google LLC through Google Analytics 4, solely to produce the usage statistics described above, under Google's own privacy policy.

If you consent to advertising, technical data is processed by Meta Platforms, Inc. through the Meta Pixel, so that we can measure and target advertising for this programme, under Meta's own privacy policy.

If you do not consent to a category, no data is sent to that provider. We do not sell your personal data. Apart from the providers named above, and apart from service providers acting on our instructions (such as Stripe for payment processing), we do not disclose your personal data to anyone else. In particular, we do not share your personal data with DATA, DCTOO, or participating establishments for this programme; any statistics we share with them are aggregated and do not identify you.

Cross-border transfer

scheme verge is based in Japan, and personal data processed for this programme — including through the Horai App — is transferred to Japan. Google Analytics and Meta also process data on infrastructure that includes the United States. So personal data may be transferred outside the Philippines — to Japan, and, where you have consented to analytics or advertising, to the United States and other countries where those providers operate. Transfers to our analytics and advertising providers happen only after you consent, only for the purposes described above, and they stop when you withdraw consent.

Retention

The consent cookie is kept for up to one year, or until you withdraw consent — whichever comes first. Analytics data held by Google is retained for 2 months for event-level data, and up to 14 months for data associated with your Cookie, user ID, or advertising ID, after which Google deletes it.

Information collected through the Horai App is retained for as long as your account is active, and for a period afterwards that is currently App retention period — to be confirmed.

Your rights under the Data Privacy Act of 2012 (RA 10173)

You have the right to be informed, to access, to object, to correct, to erasure or blocking, and to data portability regarding your personal data, as well as the right to file a complaint with the National Privacy Commission (NPC) and to claim damages where applicable. To exercise any of these rights, contact us below.

Children

Davao Tourist App powered by Horai is not directed at children. Under the Horai Service Terms, a user who is a minor must obtain the consent of a parent or legal guardian before using the service. We do not knowingly collect personal data from a child without that consent.

Data Protection Officer

Under the Data Privacy Act, scheme verge designates a Data Protection Officer as the point of contact for privacy matters relating to Davao Tourist App powered by Horai: Tatsuki Yamanami (CEO, scheme verge, Inc.), support@horai.sv. For enquiries in Japanese, you may also contact +81 50-3702-1984. You may also file a complaint directly with the National Privacy Commission of the Philippines.

Registration with the National Privacy Commission

Registration of a data processing system with the NPC is required where an organisation has 250 or more employees, processes sensitive personal information of 1,000 or more individuals, carries out processing that poses a high risk to individuals, or performs automated decision-making or profiling. scheme verge has around a dozen employees and does not process sensitive personal information at that scale. Although the Horai App collects location information in order to provide map and route features, we do not use it to profile individual visitors, and we do not carry out automated decision-making. Where you consent to advertising, we use the Meta Pixel solely to measure the performance of advertising for this programme; we do not use it to build custom audiences or otherwise profile individual visitors. On that basis, we do not currently register a data processing system for this programme. We will revisit this if the scope of processing changes — for example, if the app begins recommending places to individual visitors based on their movement or itinerary data, or if we begin using Meta's audience-building features.
