Davao Tourist Passport — additional terms

This page sets out additional terms that apply specifically to the Davao Tourist Passport programme, under Article 21 of the Horai Service Terms (the base terms for the Horai App and Horai Web). They apply together with, and are subordinate to, the base Horai Service Terms — if anything here conflicts with the base terms, the base terms control.

Who this programme is

Davao Tourist App powered by Horai is presented by the Davao Tourism Association, Inc. (DATA), which brings together the participating establishments. Each participating establishment is the seller of its own products and services, and defines and is responsible for the perks it offers. scheme verge, Inc. provides and manages the underlying technology platform only and is not a party to, and does not facilitate, any transaction between you and an establishment.

Free of charge, for now

Davao Tourist App powered by Horai is currently free to use. This may change in the future; if it does, we will update this page.

Perks are set and honoured by each establishment

Perks and offers shown on this site are set, honoured, and can be changed, limited, or withdrawn at any time by the participating establishment, without notice. Neither DATA nor scheme verge guarantees the availability, terms, or continuation of any perk.

Not a government-issued travel document

Acceptable use

This site and the Horai App, as they relate to this programme, are provided for personal, non-commercial trip-planning use. Please do not scrape, republish, or otherwise misuse the establishment information listed here.

We are not a party to your transaction with an establishment

Any issue relating to a perk — its availability, redemption, or quality — is a matter between you and the participating establishment. DATA and scheme verge are not responsible for the conduct of any establishment or for any loss arising from your dealings with one.

Service changes

We may change, suspend, or discontinue any part of this site or the establishments and perks listed on it at any time.

Governing law

These additional terms do not change the governing law set out in the base Horai Service Terms (the laws of Japan).

Nothing in these terms or in the base terms limits any right you have under mandatory Philippine law, including the Data Privacy Act of 2012 (Republic Act No. 10173) and the Consumer Act of the Philippines (Republic Act No. 7394). Personal data handled in connection with this programme is handled in accordance with RA 10173, as described in our privacy notice.

If you are resident in the Philippines, scheme verge will not rely on the exclusive jurisdiction clause in the base Horai Service Terms to prevent you from bringing a claim before the courts of the Philippines.

If you have an issue with a specific perk, please raise it with the participating establishment offering it first.
